Purpose and acceptance
These terms and conditions govern distance sales concluded on ceciletrousse.com between Cécile Trousse and any person making a purchase. The customer acknowledges having read them before placing the order. Validation of the order constitutes acceptance of these terms and conditions in the version applicable on the date of purchase.
Products
The essential characteristics, dimensions, media, techniques and prices are presented on each product page. Original artworks are unique pieces. Reproductions may be manufactured by a specialised service provider on behalf of Cécile Trousse.
Photographs are taken as faithfully as possible. Slight differences in colour may result from the screen, the lighting or, for a reproduction, the printing process, and do not necessarily constitute a lack of conformity.
Prices
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (Code général des impôts). Delivery costs and any additional charges are displayed before final validation of the order. For delivery outside the European Union, customs duties, import taxes or local charges may be levied by the authorities of the destination country and are borne by the customer.
Orders
The customer checks the contents of their basket, their contact details and their delivery address before validating the order. The sale is concluded once payment has been validated and the order confirmation has been sent. Cécile Trousse may refuse or cancel an order for a legitimate reason, in particular in the event of exceptional unavailability, an obvious pricing error, suspected fraud or an unresolved prior dispute.
If a product is unavailable after the order has been placed, the customer is informed as soon as possible and refunded the sums paid for the unavailable product.
Payment
Payment is made using the methods offered when placing the order. It is processed by the shop's secure payment service providers. The order may be suspended or cancelled if payment is declined or fails.
Delivery
The available delivery areas, methods and costs are indicated when placing the order. The stated delivery times are estimates unless a specific date has been expressly committed to. Where no specific delivery time is indicated, the order is delivered without undue delay and no later than thirty days after the conclusion of the contract, unless otherwise agreed with the customer.
Detailed terms are set out in the Shipping Policy.
Transfer of risk and ownership
The seller retains ownership of the products until the price has been paid in full. For a consumer customer, the risk of loss or damage passes when the customer, or a third party designated by the customer other than the carrier proposed by the seller, takes physical possession of the product.
Withdrawal, returns and refunds
The terms of the right of withdrawal, its exceptions, returns and refunds are set out in the Refund Policy, which forms an integral part of these terms and conditions.
Legal guarantees
Consumer customers benefit from the legal guarantee of conformity provided for by the French Consumer Code (Code de la consommation) and the guarantee against hidden defects provided for by articles 1641 et seq. of the French Civil Code (Code civil). These guarantees apply independently of any commercial guarantee that may be offered.
Intellectual property
The artworks, reproductions, photographs, texts, videos, graphics, logos and other content on the site are protected by intellectual property law. Their purchase does not transfer any right of reproduction, public performance, adaptation or exploitation. Any use other than strictly private use requires the prior written authorisation of Cécile Trousse.
Liability
Cécile Trousse cannot be held liable for any damage resulting from misuse of the product, incorrect information provided by the customer or an event of force majeure. No provision of these terms and conditions limits the mandatory rights of the consumer or any liability that cannot be excluded by law.
Personal data
The processing of personal data is described in the shop's Privacy Policy.
Complaints and mediation
Any complaint must first be sent to Cécile Trousse at ceciletrousse@gmail.com or by post to Cécile Trousse, 35 avenue Jean Jaurès, 73000 Chambéry, France.
[TO BE COMPLETED BEFORE PUBLICATION: name, postal address and website of the consumer mediator with which Cécile Trousse is registered. Do not reuse the link to the former European ODR platform, closed since 2025.]
Governing law
These terms and conditions are governed by French law. In the absence of an amicable resolution, the dispute shall fall within the jurisdiction of the competent courts in accordance with the applicable legal rules. The consumer may not be deprived of the mandatory protections provided by the law of their country of residence.
